Obtaining a title insurance license

Title producers and agencies may apply electronically on SIRCON. For procedures, see the Exam & Licensing Procedures page.
When a title producer obtains a license, it will show as “active“. However, even with an active license, individual title producers are not “authorized” to do title insurance business until they are affiliated with either a title agency or title insurer. A title agency must be affiliated with a title insurer in order to be “authorized“.
Complete application
Unless all questions are fully answered and all forms and fees required by the application are completed and attached, the application cannot be processed.
Before operating as an agency
A certificate of appointment is required from each company represented. It must be filed electronically in SIRCON.
Specific requirements regarding title insurance agencies
- Rule R590-154 requires that the name of an insurance agency licensed in the State of Utah must not be
(1) misleading or deceptive;
(2) likely to be mistaken for another licensee already in business; or
(3) implies association or connection with any other organization where actual bona fide association or connection does not exist. - A title insurance organization must maintain a fidelity bond or a professional liability insurance policy in an amount no less than $250,000 [31A-23a-204(2)]. Proof of this bond or policy must be submitted with the application.
- All agents designated to represent an organization must be individually licensed in Utah.
- A person that receives a new license on or after July 1, 2007 as a title insurance agency, shall at the time of licensure, be owned or managed by one or more natural persons who are licensed with the following lines of authority for at least three of the five years immediately preceding the date on which the title insurance agency applies for a license – Both a search line of authority; and escrow line of authority; or a search and escrow line of authority [31A-23a-204].
- A title insurance agency must have a physical office in Utah staffed by a person with an escrow subline of authority who processes the escrow [31A-23a-406(2)(i)].
Licensing fees
The Department sets its licensing fees in accordance with Utah Code 63J-1-504.
Agency title insurance producer annual report
Agency title insurance producers are required under 31A-23a-413 and R592-11 to file an annual report that includes specific information about financials and branch offices.

Nonresident title producers
Nonresident producers will be issued a non-resident producer license via reciprocity if they hold the equivalent producer license and related title line(s) of authority in their resident state. Title lines of authority that are offered in the state of Utah are:
- Title Examination (which includes authority to act as a title marketing rep)
- Title Escrow (which includes authority to act as a title marketing rep)
- Title Marketing Representatives
The title producer license in some states authorizes a producer to perform title search, but not title escrow. If a non-resident producer desires a title escrow line of authority in Utah, the non-resident producer will be required to complete the Utah Producer’s Examination for Title Escrow at any Prometric test center.
